9:00 a.m. — 9:20 a.m. ER 1006: Summaries are your friend – and the judge’s!
Everyone likes a happy judge! Patrick Rawnsley will address the intricacies of ER 1006 and the submission of voluminous information in the form of a summary. He may even tell a cautionary tale or two! This session will include a brief panel
discussion with Q&A.
9:20 a.m.—10:00 a.m. ER 904: The most efficient way to admit fact-based
documents into evidence. Jennifer Johnson will introduce ER 904, and discuss when and how to use it, when and how to object, and the effects of the rule. This session will include a brief panel discussion with Q&A.
10:00 a.m. – 10:30 a.m. ER 801: Say what?! Patrick Rawnsley and Jennifer Johnson will lead a lively interactive discussion with the CLE participants and Judge Schaller about what constitutes hearsay and what does not.
10:30 a.m. – 10:40 a.m. BRAIN BREAK
10:40 a.m. – 11:40 a.m. ER 803: So it does come in! Following the lively interactive discussion on what constitutes hearsay and some much needed recovery time,
Patrick Rawnsley and Jennifer Johnson will delve into ER 803 and many of the
hearsay exceptions, including present sense impression, excited utterance,
statements for purpose of medical diagnosis or treatment, business records, other records, and market reports. It is sure to be riveting, and Judge Schaller will be on hand to steer the discussion in the right direction!
11:40 a.m. – 11:55 a.m. ER 702: How do I qualify an expert to testify? Jennifer Johnson will share her experience regarding expert testimony and how to get it admitted into evidence with special guest Judge Schaller on hand to bolster her presentation.
11:55 a.m. – 12:10 p.m. ER 607 and its cohorts: Patrick Rawnsley will discuss how to attack credibility of a witness, with a focus on ER 613: Prior Statements of
Witnesses.
