“Snitch Fix: The Six-Year Effort to Prevent Wrongful Convictions Involving False Incentivized Testimony” presented by Attorney Lara Zarowsky, Policy Director, Innocence Project Northwest
False testimony by a witness who was given a deal (i.e. leniency or some other kind of payment) by the State in exchange for their testimony is one of the primary factors contributing to the conviction of the innocent in Washington State and nationally. While incentives can be an important tool in investigating and prosecuting crimes, current practice does not provide adequate protections to discourage witnesses from lying on the stand in order to get a deal for themselves at the expense of the actually innocent. Every case of wrongful conviction is one in which the actual perpetrator was not held accountable, in some cases allowing them to commit additional crimes while the innocent languished in custody. Known cases of wrongful conviction make clear that more detailed information about incentivized witnesses and the manner in which such testimony was developed is necessary to protect the truth-seeking function of our criminal trials. This presentation will discuss efforts by Innocence Project Northwest and the University of Washington School of Law’s Legislative Advocacy Clinic over the past six legislative sessions to pass legislation to increase transparency when incentivized testimony is offered in criminal trials.
